Any data downloaded/exported from the National Registry of Exonerations (“Registry”) should be viewed as a snapshot in time, since the Registry's data changes on a daily basis.
The individual downloading this export (“Licensee”) is granted a license by the Registry and National Registry of Exonerations Foundation (“NREF”) and permitted to use and reference the exported Registry data for educational, advocacy, research, and media purposes, provided that Licensee complies with the following requirements:
1. Attribution, Notice, and Accuracy: Licensee must clearly and properly credit and cite to the Registry as the source of the data, and the data must be represented accurately. Licensee agrees to inform the Registry of any suspected errors in the data or texts contained in the spreadsheet/export.
2. Prohibition on Machine Learning: Licensee shall not submit Registry data into any artificial intelligence software or machine learning programs for any purpose, including but not limited to duplication, interpretation, or replication. Licensee agrees not to provide the exported Registry data to any third party without explicitly informing such third party of this prohibition.
3. Prohibition on Duplication and/or Website Creation: The licensed data shall not be used in creating a website or similar publication tracking or analyzing wrongful convictions or exonerations in the U.S. Licensee shall not post an exported spreadsheet of Registry data, or any portion thereof, online or elsewhere with public access. Licensee shall not duplicate or imitate the Registry’s website.
4. Ownership: The Registry and NREF shall at all times own and retain all rights, title, and interest to the data provided to Licensee by the Registry, and no ownership rights to the data shall be transferred to Licensee.
5. No Representations and Warranties; No Liability: The Registry prides itself on its accuracy, reliability, and reputation, but its work is not beyond error. The licensed data, and any other information made available to Licensee by the Registry, is provided "as is" without representations or warranties of any kind. The Registry, NREF, and the staff, volunteers, and agents of each, have no liability with respect to the licensed data or any information available on the Registry website.
6. Term: The term of this limited license shall be perpetual unless terminated or revoked by the Registry or NREF. This license is non-exclusive, non-transferable, and is at all times revocable by the Registry and NREF.
