On March 15, 2014, police in Houston, Texas, arrested 44-year-old Homer Armstrong after confiscating tablets they suspected were Alprazolam, an anti-anxiety drug.
Armstrong was released on bond on March 16 and on July 31, 2014, he pled guilty in Harris County Criminal District Court to a misdemeanor charge of possession of a controlled substance. He was sentenced to four days in the Harris County Jail with credit for two days already served after his arrest.
On October 15, 2014, the Houston Police Crime Laboratory reported to the Harris County District Attorney's Conviction Review Unit that tests were negative for the presence of any illegal substance.
The prosecution then notified Armstrong's defense attorney and joined in a motion to vacate the conviction and dismiss the charge. The motion was granted and the case was dismissed on August 31, 2015.
